Terms of Service
Tabor Security, Inc.
Effective Date: April 24, 2026 | Last Updated: April 24, 2026
Please read these terms carefully. These terms contain a binding arbitration clause and class action waiver that affect your legal rights. They also contain important disclaimers and limitations of liability.
1. Acceptance of Terms
These Terms of Service ("Terms") form a binding agreement between you and Tabor Security, Inc., a Delaware corporation with offices at 1515 N Federal Highway, Suite 300, Boca Raton, FL 33432 ("Tabor," "we," "us," or "our"). By accessing or using the website located at taborsecurity.com and any related subdomains (the "Site"), by requesting a demo, by downloading any whitepaper or other resource we make available, or by otherwise using the Site, you agree to these Terms.
If you do not agree to these Terms, do not use the Site.
These Terms govern your use of the Site and free resources only. Production use of Tabor's OT sensor platform, dashboards, and related services (the "Service") is governed by a separate Master Subscription Agreement ("MSA") or other written agreement executed between Tabor and the subscribing customer, together with the applicable order form and Data Processing Addendum. Nothing on the Site grants any license to the Service.
2. Who May Use the Site
You represent that you are at least 18 years old and have the legal authority to enter into these Terms, on your own behalf or on behalf of the organization you represent. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization, in which case "you" refers to that organization.
The Site is intended for business and professional use by operators of critical infrastructure, security professionals, investors, channel partners, and other commercial users. The Site is not directed to consumers or to children under 16.
3. Nature of the Service; No Guarantee of Detection
The Service is a detection aid. Tabor provides passive network monitoring technology intended to assist customers in identifying and investigating potential cybersecurity events on operational technology networks. The Service is one layer within a defense-in-depth security program.
Tabor does not guarantee that the Service will detect, prevent, mitigate, or remediate any particular threat, vulnerability, malware, attack, incident, breach, data loss, or outage. No intrusion detection, network monitoring, or threat detection product can detect every threat. New and evolving threats, evasion techniques, encrypted traffic, network misconfiguration, sensor placement, tuning choices, the customer's response practices, and other factors all affect detection outcomes, and many of these are outside Tabor's control.
Customer responsibilities. The customer is responsible for its own security program, including incident response, containment, eradication, recovery, business continuity, disaster recovery, legal and regulatory notification, and communications with third parties. Alerts, findings, and recommendations produced by the Service are advisory only. The customer is responsible for validating, prioritizing, and acting on any alert. Tabor does not act as a managed security service provider, does not provide 24/7 monitoring unless expressly contracted to do so in a written MSA, and is not a fiduciary of the customer.
No safety-critical reliance. The Service is not designed, intended, or authorized for use as the sole or primary safeguard in life-safety, medical, aviation, nuclear, or other applications in which failure of detection or availability could result in death, personal injury, environmental damage, or catastrophic property damage. Any such use is at the customer's sole risk.
4. Demos, Trials, and Evaluation Use
Tabor may make demonstration environments, trial access, proof-of-concept deployments, or beta features available at its discretion (collectively, "Evaluation Use"). Evaluation Use is provided "AS IS" and "AS AVAILABLE," without any service levels or support commitments, and may be modified, suspended, or terminated at any time. The disclaimers and limitations in Sections 10 and 11 apply to Evaluation Use in full.
5. Accounts and Credentials
Some parts of the Site may require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us promptly at security@taborsecurity.com of any suspected unauthorized access. Tabor is not liable for losses caused by compromised credentials, except to the extent caused by Tabor's breach of its own security obligations.
6. Acceptable Use
You agree not to, and not to permit any third party to:
- use the Site or any materials on it in violation of any law, regulation, or third-party right;
- reverse engineer, decompile, disassemble, or otherwise attempt to derive source code or underlying algorithms of any software made available through the Site, except to the extent such restriction is prohibited by law;
- circumvent, disable, or interfere with security-related features of the Site;
- probe, scan, or test the vulnerability of the Site, or breach any security or authentication measures, except pursuant to a written authorization from Tabor;
- upload or transmit viruses, worms, malware, or other harmful code;
- use automated means (including scrapers, bots, or crawlers) to access the Site other than generally available search engine indexing;
- use the Site to train, fine-tune, or evaluate any artificial intelligence or machine learning model, or to generate datasets for any such purpose, without Tabor's prior written consent;
- impersonate any person or entity or misrepresent your affiliation with any person or entity;
- use the Site to compete with Tabor, benchmark the Service against a competing product, or develop a competing product; or
- resell, sublicense, or commercially exploit the Site or any content on it, except as expressly permitted.
Security research. If you believe you have discovered a vulnerability in the Site or the Service, report it to security@taborsecurity.com. Do not publicly disclose a vulnerability before Tabor has had a reasonable opportunity to investigate and remediate. Tabor will not pursue legal action against good-faith researchers who comply with this Section.
7. Intellectual Property
Tabor property. The Site, the Service, and all content, software, code, text, graphics, images, videos, trademarks, and other materials made available on or through them (collectively, the "Tabor Materials") are owned by Tabor or its licensors and are protected by U.S. and international intellectual property laws. "Tabor," the Tabor logo, and other Tabor product and service names are trademarks of Tabor. You may not use them without our prior written consent.
License to use the Site. Subject to your compliance with these Terms, Tabor grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Site for its intended purpose. All other rights are reserved.
Feedback. If you submit suggestions, feedback, or ideas regarding the Site or the Service, you grant Tabor a perpetual, irrevocable, worldwide, royalty-free, fully paid-up license to use them for any purpose without obligation to you.
Whitepapers and downloadable content. We may make whitepapers, guides, reports, and similar materials ("Resources") available for download. Tabor grants you a non-exclusive, non-transferable license to view and share the Resources internally within your organization, without modification and with all attribution and legends intact. You may not republish, resell, or use the Resources as part of a commercial offering without Tabor's prior written consent.
8. Third-Party Services and Links
The Site may contain links to, or integrate with, third-party websites, services, and resources. Tabor does not control and is not responsible for those third parties. Your use of any third-party website or service is governed by that third party's terms and privacy policy.
9. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Site, you acknowledge our Privacy Policy.
10. Disclaimers of Warranty
The Site, any Resources, and any Evaluation Use are provided "as is" and "as available." Tabor and its licensors, suppliers, affiliates, officers, directors, employees, agents, and channel partners (collectively, the "Tabor Parties") make no warranties, express or implied, and to the maximum extent permitted by law disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing, usage, or trade.
Without limiting the foregoing, the Tabor Parties do not warrant that: (a) the Site, Resources, or Evaluation Use will be uninterrupted, secure, or error-free; (b) the results obtained from use will be accurate or reliable; (c) any alert, report, or recommendation will detect, prevent, or mitigate any particular cybersecurity event, threat, malware, intrusion, incident, breach, data loss, or outage; or (d) defects will be corrected.
You acknowledge that cybersecurity is inherently uncertain and that no product or service can eliminate cybersecurity risk. The Tabor Parties have no obligation to compensate you for any failure to detect or prevent a cybersecurity event.
Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the above exclusions apply to the fullest extent permitted by law.
11. Limitation of Liability
To the maximum extent permitted by law, in no event will the Tabor Parties be liable to you or any third party for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, use, or other intangible losses, or for business interruption, regulatory fines or penalties, third-party claims, or costs of substitute goods or services, arising out of or in connection with these Terms, the Site, any Resources, or any Evaluation Use, even if a Tabor Party has been advised of the possibility of such damages and even if a limited remedy fails of its essential purpose.
Without limiting the foregoing, the Tabor Parties will have no liability for: (a) any cybersecurity event, intrusion, data breach, ransomware, malware, outage, process disruption, physical damage, or safety incident affecting you or any third party; (b) any failure to detect, prevent, alert on, or recommend a response to any of the foregoing; or (c) any decision you or any third party make in reliance on the Site, any Resources, or any output of Evaluation Use.
In no event will the aggregate liability of the Tabor Parties arising out of or relating to these Terms, the Site, any Resources, or any Evaluation Use exceed one hundred U.S. dollars ($100). The parties acknowledge that this cap is a material basis of the bargain and that the Site and Resources would not be provided absent it.
Exceptions. The foregoing limitations do not apply to liability that cannot be limited under applicable law, including liability for (a) a party's gross negligence, willful misconduct, or fraud; and (b) a party's indemnification obligations under Section 12, which are governed by their own terms (as applicable).
Time limit. Any claim arising out of or relating to these Terms must be brought within one (1) year after the claim accrues, or it is permanently barred, except where a longer period is required by applicable law.
Some jurisdictions do not allow limitations on liability. In those jurisdictions, the above limitations apply to the fullest extent permitted by law.
12. Indemnification
You will defend, indemnify, and hold harmless the Tabor Parties from and against any and all third-party claims, actions, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Site, any Resources, or any Evaluation Use in violation of these Terms or applicable law; (b) your violation of any third-party right, including intellectual property, privacy, or contractual rights; (c) any content or information you submit to the Site; and (d) your negligence or willful misconduct. Tabor may assume exclusive control of the defense at its expense, and you will cooperate with reasonable requests to assist in the defense. You may not settle any claim without Tabor's prior written consent.
13. Suspension and Termination
Tabor may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including suspected violation of these Terms. Upon termination, the rights granted to you under these Terms will end immediately. Sections that by their nature should survive termination (including Sections 7, 10, 11, 12, 14, 15, 16, 17, and 18) will survive.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
15. Dispute Resolution; Arbitration; Class Action Waiver
Informal resolution. Before initiating any formal proceeding, the parties will attempt in good faith to resolve any dispute through informal negotiation. A party must send a written notice of dispute to legal@taborsecurity.com (for disputes directed to Tabor) or to the notice address on file (for disputes directed to you), describing the nature of the dispute and the relief sought. If the dispute is not resolved within thirty (30) days, either party may proceed under this Section.
Binding arbitration. Except as provided below, any dispute arising out of or relating to these Terms or the Site will be resolved by binding, confidential arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration will be conducted by a single arbitrator in Wilmington, Delaware, in English. Judgment on the award may be entered in any court of competent jurisdiction.
Class action waiver. You and Tabor agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.
Exceptions. Either party may (a) seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information, and (b) bring an action in small claims court for claims within that court's jurisdiction. If the arbitration agreement or the class action waiver is found to be unenforceable in whole or in part, the unenforceable portion will be severed and any remaining disputes will be resolved exclusively in the state or federal courts located in Wilmington, Delaware, to whose jurisdiction the parties submit.
16. Export; Sanctions; U.S. Government
You will comply with all applicable U.S. and foreign export control laws and economic sanctions regulations, including those administered by the U.S. Department of Commerce (EAR), the U.S. Department of the Treasury (OFAC), and the U.S. Department of State. You represent that you are not located in, organized under the laws of, or ordinarily resident in a country or territory subject to comprehensive U.S. sanctions, and that you are not on any U.S. government list of prohibited or restricted parties. If you are a U.S. government end user, use of the Site is subject to FAR 12.212 and DFARS 227.7202, and is provided with only those rights specified in these Terms.
17. General
Entire agreement. These Terms (together with the Privacy Policy and any additional notices referenced herein) constitute the entire agreement between you and Tabor regarding the Site and supersede any prior or contemporaneous understandings. If you have signed a separate written agreement with Tabor (including an MSA), that agreement governs with respect to its subject matter.
Changes. Tabor may update these Terms from time to time by posting the updated Terms on the Site and updating the "Last Updated" date. If changes are material, we will provide additional notice where required by law. Your continued use of the Site following an update constitutes acceptance of the updated Terms.
Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without Tabor's prior written consent. Tabor may assign these Terms at any time. Any purported assignment in violation of this Section is void.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force, and the invalid provision will be modified only to the minimum extent necessary to make it enforceable.
No waiver. Failure by Tabor to enforce any right or provision will not be a waiver of that right or provision.
Force majeure. Tabor is not liable for any delay or failure in performance caused by events beyond its reasonable control, including acts of God, war, terrorism, civil unrest, labor disputes, pandemics, government actions, failures of the internet or utilities, cyberattacks on third-party infrastructure, or shortages of components.
Relationship. The parties are independent contractors. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship.
Notices. Notices to Tabor must be sent to legal@taborsecurity.com and to the address at the top of these Terms. Tabor may give notice to you by email to the address associated with your account or by posting on the Site.
Language. These Terms are drafted in English. Any translation is provided for convenience only, and the English version controls.
